JCA came out with detailed circular after yesterday midnight. The salient features of the circular are listed below for quick reference.
Regarding ITO to ACIT promotion :
(i)The stagnation in the cadre of ITO needs to be removed.
(ii) The calculation of vacancy for the promotion in ACIT cadre has to be done keeping in mind that the stagnation in ITO cadre comes down to 12 years from the present position.
(iii) The officers who were promoted as ITO till 2003 are to be promoted in ACIT vide DPCs of R.Y.s 2014-15, 2015-16 & 2016-17.
(iv) The CBDT to obtain the necessary relaxations, if necessary, from the competent authority to ensure that all eligible persons promoted as ITOs till 2003 are promoted as ACIT and the proposal in this regard is to be sent to the Revenue Secretary soon.
(v) The DPCs for ACIT for the R.Y.s 2014-15, 2015-16 and 2016-17 will be convened by 31st March, 2016.
(vi) The number of vacancies for the R.Y.s 2014-15, 2015-16 and 2016-17 will be ascertained by the CBDT within a week’s time, taking JCA into confidence.
(vii) The formalities like removal of deficient APARs etc. for the vacancies till the R.Y. 2016-17 have to be initiated immediately.
(viii) Necessary step to vacate the Stay-order in the Court Case pending before the Ernakulam CAT has to be taken. (ix) The representatives of JCA are told to appraise the Revenue Secretary directly in cases of non-settlement of the issues.
Regarding the rest four demands in the charter :
(i)RRs of Gr.B & C cadres: After considering the suggestions of JCA the draft RRs has already been sanctioned by the Hon’ble FM and the same has been sent to the DoPT for approval.
2. Filling up of vacant posts: For relaxation of RRs, as per suggestions of JCA, a comprehensive proposal will be submitted by the HRD to the CBDT within a day or two.
3. Regularization of Casual Workers: The letter issued on 16.10.2015 on this issue has been kept in abeyance till further clarification is issued. Accordingly, intimation has already been sent to the Pr.CCCITs(CCA).

we should also say ki all scrutiny cases should be transferred from ward to circle.we will not do assessment for 10 years.

Those who thought that JCA can not achieve anything, this should come as a shock. This agitation has helped IAS SHOW its supremacy over IRS
Now TA has to wait more than 10 years to become EA as new RR has been sent to DOP&T. Thank you JCA. All TAs of 2011 & 2012 and so on become bakra in this agitation episode.

The note submitted to R.S is well-drafted but it is more elaborate and a bit difficult for outsiders to understand. Each word , each step to explain the facts , historical background has been meticulously brought out with 100% truth. But why the present leadership should adopt a soft approach when there has been treachery, a planned digging behind our back, a stand of obstinacy for nobody's benefit by the administration for such a long period. Can anyone explain , whether it is part of our agenda to mention the number of posts etc., that are required to be abolished in the higher cadres , say JCIT to CIT
What about additional vacancies for R.Y. 2013-14? Whether it will be looked into? ITGOA is demanding additional posts for this R. Y. for quite some time. Now they should work out these vacancies in the proposal to be put up before the RS and impress upon him to release some vacancies against the CR vacancies meant for R.Y. 2013-14.

DPC for R.Y 2014-15, 2015-16 AND 2016 -17 are to be completed by 31-03 -2016, this means DPC for 2014-15 will further delay. what we have gained from this agitation Board was ready to give 180 promotions for 2014-15 in January 2015 itself, we are not going to get any vacancy in R.Y. 2013-14, in fact we are looser particularly those who are to be promoted for R.Y. 2014-15 have been cheated both by the CBDT and JCA.Hame to apno ne hi loota gairon me kahan dum tha.....................
New recruitment rule probably be effected from R.Y 2013 onwards . Those who entered in the department before 2013-14 are likely to be under old recruitment rule. TAs should not be panic before its practical implementation.

What board said : I give you 180+180 for 2 years. What higher forum said : Add one more year , I give around 619. That is for three years - 619 instead of 540. Difference is 79. Out of which, 31 officers- who joined in 2003 or before - are retiring by March 2016. So , in effect 48 promotions are coming forth in addition to what board earlier said. And that too , it will come in 2016-17. may come.

How many of you feel that the CBDT will carryout the direction of the R.S?
Till such time IRS officers CBDT are handling the HRD, we can't expect any positive result from the CBDT.
It may be true that the DPC may delay due to the working on the assurance given by the R.S. But it is also true that without getting the revocation of CAT' stay, DPC for R.Y. was already going to be delayed further.
The intervention of the R.S. may work in our favour and the delay dallying of the Board who has not only bluffed the JCA in the last Feb PGRC meeting by assuring that the DPC for the 2014-15 will be held in a month, the JCA has believed the same have given reasonable time for the same. But the Board had no intention and it didnot circulated the deficiency list in APAR timely. After such a long agitation, the Board has simply took 10 months time to circulate the deficiency for R.Y.2015-16. We all know that the DPC for R.Y.2016-17 is going to be due by 1st January 2016, which is only one and half months away, the deficiency list for R.Y. 2014-15 is not circulated, which proves that the Board has no intention to follow the DPC model calendar and is not going to circulate in near future and this DPC will also got delayed by years.
In my view the blame on JCA that it has not tried to get the DPCs at the earliest is not correct.
Further, the issue of leaving the issue of regularisation of adhoc JCIT/Addl.CIT in the meeting with the R.S. is not against us as the same is not going to increase the vacancies at the DCIT/ACIT level any more. Instead, we should demand for the diversion of DR quota and relaxation in rota rule to get all the consequential vacancies from CRC 2013 to get additional posts. For which, the relaxation from the DOPT for promotion in the JCIT/Addl.CIT from the dcit/ACIT cadre may be obtained and this will automatically release the posts held up in the JCIT/Addl. CIT cadre.
I appreciate the expressions and concerns of the members towards their career, but we all should have positive approach. The discrimination between the cadres in all the department including our department is the legacy of past and we have to suffer, as the vested interest are not going to allow to reduce the same easily.
New RR will be applicable from Recruitment 2016-17 because, RR will be effective from the date of their publications in the gazzetee of India. Up to R.Y 2015-16 DPC and DR Recruitment is already completed in old RR.
How the Income Tax Department will run the offices by regularizing the casual workers and by issuing appointment letter to all compassionate people. Majority of the employees in the department will be both casual worker and compassionate appointee people who are below matriculate or open schooling graduates who are not meeting the normal standard of the existing works. JCA is making the department as "DHARMSALA" OR REHABILITATION CENTRE by demanding ILLEGITIMATE DEMAND to the REVENUE SECRETARY regarding Casual Workers.Those casual workers should be rehabilitate who are doing cleaning works, Peon Works but the number of casual workers are increasing day by day because of the addition of Computer Operator(Named as Daily Wage Worker.Why the JCA going against the ethics of the department. Computerization is increasing day by day with the introduction of ITBA, Convergence, AST, BCP, I-tax Net, Departmental E-filing portal, CPC A.O portal etc. but everything is operated by the so called Daily Wage Workers(Computer Operator). The Computer Operators( DW) are killing the future of the original Casual Workers(Peon Worker). some notorious people in the department given some shelter to thier relatives in the name of Casual Workers and now demanding the regularisation of Daily Paid Workers instead of the demand of the existing and new comers to the department. There is no seat for TAX ASSISTANT, ITI of 2013 and earlier batch but the Computer operator(DW) have occupied the seats and computers for the system works which are not supposed to be done by the DW. SHAME JCA.Now a days I.T department need professional employees who knows comuter, accounts and English Knowledge as structured by the STAFF SELECTION COMMISSION EXAMINATION.
The JCA may clarify that in the 2001 CR the DPCs for two years were not done one of the regions of our department for the lower cadre will review now?
The CoS is believed to have recommended the name of Atulesh Jindal for the post of Chairman CBDT. He is 1978 batch IRS (IT) officer. Present Chairperson Anita Kapoor is retiring by this month end.
Has the senior most Member in the CBDT A K Jain lost the race for the post of Chairman CBDT ? Member (Personal and Vigilance ) Jain will get only two months if he is appointed Chairman. In case he is appointed he would get two months extension in service in view of the Budget beginning February 1. Decision of the PMO would only be known on December 1.
RRs are related to vacancy year and DPCs from vacancy year 2016-17 on-wards will govern on the basis of new RRs if dop & t approves the file sent by cbdt. Present Chair person has done nothing fruitful during her tenure for the employees of the Department. A lot of pending promises like laptop to ITI, increased petrol allowance, cell phone to employees etc are long pending. We have to wait for another 24 days to get rid of this inactive Chair person.

The present chairperson will get a graceful escape by be fooling the JCA and so called 97% workforce, all the promises made before our leaders and RS will be futile as no DPC for promotion of ITO is likely to be held for another 6 month as now when everything is over and agitation is called off (not suspended as it will never be relaunched)suddenly the Ernaculam CAT stay come to their notice. are we fooL ? the Ernaculam CAT has granted stay 4 moths back what the CBDT has done so far to get the stay vacated ? are they sleeping? now when the RS asked to conduct DPC they are taking plea of Ernaculam CAT? they are determined to not to conduct DPC what will you people do they have all the guts after all they are IRS and you are their slaves.
It is learnt that the UPSC has returned the proposal for DPC by saying that get the Ernculam stay vacated whether the CBDT and JCA did not know about the Ernaculam CAT stay ? why they have not taken step to get the stay vacated, why the CBDT and also JCA played with the sentiments of the members by saying that DPC will be conducted immediately. Why the JCA has hide this fact from members. when the matter was subjudice and promotion can not be made why the agitation was launched? and why the agitation was suspended on false promises when nobody is going get any promotion,will the agitation will be again launched after 24 nov. as there is no possibility of fulfillment of demand for conducting DPC by 24th NOV IN THE LIGHT OF Ernaculam CAT stay, or the JCA will comeup with another storey?

Nearly one week has passed after the meeting of JCA with RS. After this meeting, JCA temporarily suspended the ongoing agitstation for 3 weeks. But the CBDT has not take any steps on the direction of the R. S.
NRP cannot be competed.

राजीव केसरवॉनी की एक SLP की सुनवाई सर्वोच्च न्यायालय में चल रही है। इसमें betterment को चुनौती दी गयी है। राजीव केसरवानी cat और high court में यह लड़ाई जीत चुके है और सर्वोच्च में भी जीत जाएँगे क्योंकि betterment की भारतीय संविधान में कोई जगह नहीं है। यह कुछ लोगों ने अपनी सुविधानुसार बना लिया। इस तरह का नियम भारत के किसी भी सरकारी विभाग में लागू नहीं है। कुछ माह में सर्वोच्च न्यायालय का फ़ैसला आने के बाद इसके implenentation से General candidates की बहुत सारी vacancy हर कैडर में निकलेगी। अगर nrp के implementation से पहले यह फ़ैसला आ जाता है तो आज ITO से acit प्रमोशन में देरी की भरपाई हो जाएगी
