Update on ACIT promotion (Adhoc promotion for 2016-17 and regularization of 2014-15)

1)The UPSC has taken a stand that DPC will not be held so long the DoPT doesn't clarify the OM dt. 30.09.2016. The same was intimated to CBDT in writing while the proposal of 2014-15 was sent.
2)DoPT is waiting for verdict from SC and not issuing clarification.
3)The SC heard the case on 22.11.2016 and allowed the respondants to file affidavit in one week. Next date of hearing not given. It seems to take much time for a verdict to come.
4) CBDT is not ready to give adhoc promotion of 2016-17 in fear of contempt of court and violation of DoPT OM.
5) No hope for both the regular promotion of 2014-15 and adhoc promotion of 2016-17 immediately, if these conditions persist.

No promotions till all decisions of Supreme Court relating to seniority are implemented and wrong promotions given earlier on baseless judgement should be cancelled immediately

What is happening to the giants of ITGOA. Can't they read through the DoPT OM and how it affects the ACIT promotions as such. If any ITGOA leaders are reading this please under stand the following:

1. The promotion is ad-hoc in nature at the first instance
2. The DoPT OM dtd. 30.09.2016 speaks as "till such time the SLP(S) are decided by the Hon'ble SC, while considering promotion, the DoPT OM dated 10.08.2010 and RB Circular dtd. 14.9.2010 are not to be relied upon".
3. The DoPT OM dtd. 10.09.2010 speaks of adjusting reserved candidates agnst unreserved posts in promotions made in non-selection method.
4 The ACIT post is a selection method, which has nothing to do with the implementation of DoPT OM dtd. 10.09.10, cause such adjustment was there in ACIT post as it is selection post before the issue of DoPT OM 10.09.10.
5. So unnecessarily a doubt is being created which is not at all there.
6. Request the ITGOA leaders to go through the circulars and take up the matter with CBDT.

A Meeting of JCA was held with the Chairman on 26.11.2016 . The file of 2014-15 was signed by Chairman on the same day to send to RS for onward submission to DoPT seeking clarification of OM dt. 30.09.16. as per the advice of UPSC. In regard to 2016-17, the Board sought 10 days time in the meeting to wait for DoPT's clarification of the said OM and if it does not reach CBDT by then, the process of holding adhoc DPC will be initiated as per CBDT's understanding of the OM. As regard to Pr. AO, the Board will publish all India seniority list of AO, Gr.II on 09.12.2016 giving 15 days time for objection and following which the Board will proceed for ad-hoc promotion on the basis of model RR.
We met the officers of DoPjaiT today to request for clarification of the OM, but they denied to issue any such clarification at least before 06.12.16, the next date of hearing in the SC.

In regard to ADHOC 2016-17, the Board had sought 10 days time in the meeting dt. 26-11-2016 to wait for DoPT's clarification of the OM dt. 30-09-2016 and if it does not reach CBDT by then, the process of holding adhoc DPC will be initiated as per CBDT's understanding of the OM. Now, 10 days has already elapsed but it seems nothing is happening in the Board or department.

With the Investigation wing seeking for more man-power from the CCA"s post demonetisation, it appears, that this is the right time for the JCA to press for their legitimate demands including holding Adhoc DPC for 2016-17. If this ship is missed, then the organization which is claiming to be the pillar of the department consisting of more than 97% of the total workforce of the department will have to step back and the higher-ups will have the last laugh.
