in NER altogether 5 ITOs got promoted on Ad-Hoc basis. all of them belongs to promotee cadre.
Is the latest Honourable Supreme Court Judgement in Civil Appeal No.4596,4597 of 2017, dt.26-10-2017 regarding date of joining taken into consideration?
Please provide full details of this decision as many DRs have got promotion before they were graduate
I am fully dissatisfied over the issue of proposal for conversion of Staff Car Drivers into the cadre of Tax Assistant raised by our JCA in the grievance meeting held on 10.11.2017 without judging the qualification, technical expertise, duty and responsibilities of a Tax Assistant in Income Tax Department. Many Staff Car Drivers of our department have crossed their pay more than the pay of IIT/ITO. Can they be made IIT/ITO directly on the basis of pay. The answer may be "No" because of the points which I have mentioned above. Hence,they may not be made TA directly. They may be utilised for some general jobs where they found to be suitable based on equivalency of post of Staff Car Driver.
As per the recent decision of Hon'ble Supreme Court in the case of Sunaina Sarma and Others Vs. State of Jammu and Kashmir, a person is entitled to seniority only from the date when the person actually joins the Department. Representations were sent by some officials/officers to CBDT Chairman in this regard. The Judgement can be downloaded from internet in Supreme Court portal.
